Terms of Service

The agreement

These terms govern your use of Score, a Rate Tracker product. By signing in or using the service, you agree to them. If you’re using Score on behalf of a company, you confirm that you have authority to bind that company.

What Score is — and what it is not

Score is a decisioning tool. It computes a structural ease score for a consumer application and renders a report. Score does not make an approval decision on your behalf, does not issue credit, and does not pull a credit report. The merchant decides how to use the ease score in their own workflow.

Eligibility

Score is offered to businesses operating in the United States, acting through representatives who are at least 18 years old and authorized to bind their organization. We may decline or terminate accounts that we reasonably believe do not meet these criteria.

Your account

You’re responsible for keeping your account credentials safe and for the activity that happens under your account. Notify us promptly at security@ratetracker.io if you suspect unauthorized access.

Acceptable use

Don’t use Score to violate the law, infringe anyone’s rights, attempt to reverse-engineer the platform, attack the service, scrape protected data, or run submissions for consumers who haven’t consented to your business relationship. Don’t share your access with parties outside your organization without our agreement.

Fees and billing

Billing is handled by Stripe. Fees, billing intervals, and any usage-based metering are presented at sign-up and in your dashboard. We’ll give reasonable notice before changing pricing on your account.

Availability and changes

We aim for high availability but don’t guarantee uninterrupted service. We may release updates, add features, and occasionally retire features with notice. Material breaking changes will be communicated in advance.

Termination

You can cancel at any time from your dashboard. We may suspend or terminate accounts that violate these terms. On termination, you keep ownership of your data and may export it for a reasonable window before deletion.

Funding offers and third-party lenders

Where Score surfaces potential funding matches from third-party lenders or capital partners, Score is acting as a referral surface only. We are not the lender, we do not underwrite the loan, and we do not guarantee approval, terms, rates, or availability. Any loan agreement is between you (or your customer) and the lender, governed by the lender’s own disclosures and contracts. Score does not earn a commission in a way that creates a fiduciary duty to either side; we operate as a neutral routing layer.

Disclaimers and liability

Score is provided “as is” and “as available.” To the extent allowed by law, Rate Tracker disclaims implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Score is a decisioning aid, not a substitute for the merchant’s own diligence. To the maximum extent permitted by law, Rate Tracker’s aggregate liability for any claim arising from these terms or your use of Score is limited to the fees paid by you to Rate Tracker in the twelve (12) months preceding the event giving rise to the claim. Final disclaimers and limitations will be confirmed by counsel before V1 launch.

Indemnification

You agree to defend, indemnify, and hold harmless Rate Tracker, its officers, employees, and affiliates from any third-party claims arising from (a) your misuse of Score, (b) your violation of these terms or applicable law, or (c) your submission of consumer data without the consumer’s consent or in violation of your own privacy obligations.

Governing law and venue

These terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles. Disputes arising from these terms or your use of Score will be resolved in the state or federal courts located in Delaware, and you consent to personal jurisdiction there. Counsel may finalize an alternative venue or arbitration clause before V1 launch; any such change will be communicated in advance.

Severability and entire agreement

If any provision of these terms is held invalid, the remaining provisions remain in effect. These terms, together with any order form or written agreement you sign with Rate Tracker, constitute the entire agreement between you and Rate Tracker regarding Score and supersede prior agreements on the same subject.
